Terms of Service

These Terms of Service ("these Terms") govern the conditions of use of the incoming-call blocking application "NoCall" ("the Service") provided by XTV LLC ("we" or "the Company"). By using the Service, you are deemed to have agreed to all provisions of these Terms.
Article 1 — Scope of Application
- These Terms apply to all matters relating to the use of the Service between us and the user.
- If you do not agree to these Terms, you may not use the Service.
- Any individual rules, guidelines, or other policies posted by us in connection with the Service ("Supplemental Rules") shall form part of these Terms. In the event of any conflict between these Terms and Supplemental Rules, the Supplemental Rules shall prevail.
Article 2 — Service Description
- The Service is an application for Android 10 and later that uses Android's call-screening role to screen incoming calls and reject those from numbers you choose to block, before the phone rings.
- The main features of the Service are as follows:
- A blocklist of phone numbers, each with an optional note and an on/off switch
- "Calls from abroad," a feature that rejects calls whose number's country differs from your device's country, with a user-configurable list of allowed countries
- A history of blocked calls, kept on your device
- An optional notification shown when a call is blocked (off by default)
- A pricing model in which blocking up to 3 numbers is free, with a monthly Premium subscription required to block more than 3 numbers or to use "Calls from abroad" (see Article 4).
Article 3 — No Account; Use of the Service
- The Service has no sign-up process and no user account of any kind. There is no username, password, or other credential to create or manage.
- All of your blocklist entries, notes, settings, and call history are stored only in the local storage of the device on which the Service is installed, as described in our Privacy Policy. Possession and use of that device constitutes your use of the Service on it.
- Because there is no account, the Service does not provide any feature to transfer, sync, or carry this data over to another device (see Article 6).
Article 4 — Fees and Payment
The Service is operated under two pricing plans: the Free Plan and the Premium Plan.
- Free Plan
- Without any registration or entry of payment information, users may add up to 3 phone numbers to their blocklist and use all other features of the Service.
- Premium Plan ("NoCall Premium")
- To block more than 3 phone numbers, or to use the "Calls from abroad" feature, the user must subscribe to NoCall Premium.
- NoCall Premium is an auto-renewing monthly subscription (product:
nocall_premium) offered through the Google Play Billing system provided by Google LLC. Its price is the price displayed in the app and on Google Play at the time of purchase, which Google Play determines based on the device's configured region. - Subscribing to NoCall Premium removes the limit on the number of phone numbers that may be blocked and enables "Calls from abroad."
- The payment method and billing process are governed by Google Play's terms. The subscription automatically renews for the same term and price unless canceled before the next renewal date, in accordance with Google Play's policies.
- Cancellation
- NoCall Premium may be canceled at any time from the "Subscriptions" section of the Google Play app.
- Even after cancellation, NoCall Premium remains active until the end of the period already paid for. No prorated refunds are issued.
- Handling After Cancellation or Expiration
- When NoCall Premium's paid term expires, the plan automatically reverts to the Free Plan.
- Phone numbers already registered on your blocklist at that time remain blocked. You may not add new numbers beyond the Free Plan's limit of 3 while on the Free Plan.
- The "Calls from abroad" feature stops being enforced. The feature's setting and your list of allowed countries are kept as they were; enforcement resumes automatically if you subscribe to NoCall Premium again.
- Refunds
- Refunds are handled in accordance with Google Play's refund policy. We do not provide refunds independently of Google Play.
- Receipts and Purchase History
- Receipts and purchase history for NoCall Premium are issued by Google Play and can be viewed by the user through the Google Play app. We do not issue receipts independently.
Article 5 — Restore Purchase
- If you reinstall the Service, or install it on a new device, you can restore an active NoCall Premium subscription using "Restore purchase" in Settings or on the paywall screen, provided you are signed in with the same Google account used for the original purchase.
- Restoring a purchase restores your subscription status only. It does not restore your blocklist, notes, allowed-country list, or history, which are device-local as described in Article 3.
Article 6 — Device Changes and Uninstallation
- Because the Service has no account and no server-side storage of your data, changing devices, factory-resetting a device, or uninstalling the app permanently erases your blocklist, notes, "Calls from abroad" settings, and call history on that device. This data cannot be recovered by us or by you once it is gone.
- Your NoCall Premium subscription itself is tied to your Google Play account, not to the app's on-device data. If you change devices or reinstall the app, use "Restore purchase" as described in Article 5 to reinstate your subscription, then re-add the phone numbers you wish to block.
- Uninstalling the app does not cancel an active Google Play subscription. To stop being charged, cancel the subscription separately from the Google Play app's subscription management screen, whether before or after uninstalling.
Article 7 — Call Blocking Behavior and Limitations
- The Service screens incoming calls using Android's call-screening role and operates under the following limitations:
- Calls with no caller ID (private or unknown numbers) are not blocked.
- Internet-based calls, such as LINE calls or WhatsApp calls, are not covered.
- If your device maker's own call-blocking feature, or another call-screening app active on your device, takes priority, it may override the Service's decisions.
- A phone number that cannot be parsed is allowed through rather than blocked.
- We make no warranty that the Service will block every call from a listed number under all circumstances, and we accept no liability for any damage arising from a call that is not blocked due to the limitations above.
Article 8 — Outgoing Calls and Emergency Numbers
- The Service only screens incoming calls before they ring. It never blocks, restricts, delays, or otherwise interferes with any call that you place from your device.
- This includes calls to emergency numbers (such as 110, 119, 118, 911, 112, and 999): the Service has no mechanism of any kind to prevent, delay, or interfere with an outgoing call, and the blocklist has no effect on calls you place.
Article 9 — Personal Use Restriction
- The Service is designed exclusively for personal use. Use by corporations or organizations, use for business purposes, and use for expense reimbursement purposes are outside the intended scope of the Service.
- We do not issue receipts, qualified invoices, or invoices of any kind.
- If you wish to use the Service on a corporate basis, please contact us separately.
Article 10 — Prohibited Conduct
Users must not engage in any of the following conduct when using the Service:
- Any act that violates laws, these Terms, or public order and morals
- Any act that infringes the rights of other users, third parties, or the Company
- Any act that damages the reputation, honor, or brand of the Company
- Reverse engineering, modifying, copying, or redistributing the Service
- Exploiting vulnerabilities in the Service
- Evading payment through unauthorized means
- Any other conduct that the Company deems inappropriate
Article 11 — Intellectual Property Rights
- All intellectual property rights in the content, software, trademarks, logos, and other materials displayed in connection with the Service belong to us or to third parties who have licensed such rights to us.
- Users must not infringe these intellectual property rights when using the Service.
Article 12 — Disclaimer and Scope of Warranty
- We make no warranty of any kind regarding the completeness, accuracy, usefulness, or fitness for a particular purpose of the Service.
- Because the Service operates via Android's call-screening role, customizations by device OEMs, battery optimization settings, or another call-screening app on the device may prevent the Service from launching or limit its functionality, in addition to the limitations described in Article 7.
- We accept no liability for any damage arising from the limitations described above, from the loss of device-local data described in Article 6, or from the use or inability to use the Service.
- Our liability shall in no event exceed the total amount paid by the user to us during the 12 months immediately preceding the event giving rise to the liability.
Article 13 — Service Changes and Termination
- We may change the content of the Service or discontinue providing it, provided that we give users advance notice.
- If we discontinue the Service, we will notify users before the termination date. Users subscribed to NoCall Premium should cancel it from the Google Play subscription management screen before termination, as termination of the Service does not itself cancel a Google Play subscription.
Article 14 — Changes to These Terms
- We may amend these Terms.
- When amendments are made, we will notify users of the content and effective date through in-app notifications. For changes to fundamental matters such as the billing structure, we will obtain renewed consent from users.
Article 15 — Mail-Order Sales and Right of Withdrawal
- The Service constitutes mail-order sales as defined under the Act on Specified Commercial Transactions (Japan).
- NoCall Premium is digital content and a digital service that becomes available for use immediately upon completion of payment. Owing to this nature, NoCall Premium is not subject to the statutory right of withdrawal (cooling-off period) under the Act on Specified Commercial Transactions.
- To cancel NoCall Premium mid-term, users may cancel at any time from the Google Play app's subscription management screen. Cancellation takes effect from the next renewal date, and no prorated refund is issued for the period already paid for.
Article 16 — Minors
- If a user is a minor (under 18 years of age), the use of the Service requires the consent of a parent or legal guardian.
- If it becomes apparent that a minor has used the Service without the consent of a parent or legal guardian, we may accept a request for cancellation of the contract from the minor or the parent or legal guardian.
Article 17 — Governing Law and Jurisdiction
- These Terms are governed by the laws of Japan.
- All disputes arising from or in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
